1.1 Treasure & Relish is a trading name of JRSO Enterprises
This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the goods (Goods) listed on our website [http://www.treasureandrelish.com] (our site) to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.
You should print a copy of these terms and conditions for future reference.
Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Goods from our site.

Acceptance of Terms and Conditions
3.1 By clicking “accept” you confirm that you have read and accept these terms and conditions.
3.2 These terms and conditions are subject to change at any time and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.
3.3 Customers warrant that they have authority to make purchases in their own name and are 18 years of age or over. Customers warrant that the information given on their order form is complete and accurate.
How the contract is formed between you and us
4.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer from us to buy Goods. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Goods have been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.
4.2 The Contract will relate only to those Goods whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Goods which may have been part of your order until the dispatch of such Goods has been confirmed in separate Dispatch Confirmation.
Availability of Goods
5.1 We will notify you by e-mail within 5 working days if any Goods that you have ordered are out of stock or if delivery will be delayed. On receiving such an e-mail notification you may amend or cancel your order using any convenient method of communication as detailed on our contacts page.
5.2 Availability of the Goods displayed on our website is not guaranteed.
Payment
6.1 All payments will be in pounds sterling (£) and payment will be accepted using any of our acceptable payment and ordering methods. Payments can be made online using the secure online encrypt server: 128bit SSL (Secure Socket Layer). Payments are handled by SagePay which is part of the SAGE group.
6.2 Alternative payment methods: A sterling cheque or international banker’s draft/money order made payable to Treasure & Relish.
6.3 In the event that Treasure & Relish provides any approximate conversion rate information in foreign currency this shall be for general guidance only.
6.4 VAT is not currently charged.
6.5 If you order Goods from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
6.6 Please also note that you must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable for any breach by you of any such laws.
6.7 We reserve the right to change prices from time to time.
6.8 Title of the Goods will pass to you only when full payment has been received for them. In the event of our bank informing us that any credit card provided by a customer has been used without authority or otherwise improperly used the customer shall be obliged to return the goods forthwith.
Delivery
7.1 Any delivery rates and arrangements published on our website are subject to Treasure and Relish staff checking that our normal carriage arrangements are appropriate for the works selected. We will contact the customer to seek agreement to any modifications we propose.
7.2 Risk in the Goods passes on collection or on delivery of the goods to the address stated in your order.
7.3 All orders will be delivered by our couriers or chosen postal service to the address you supply. We do not deliver to addresses containing PO Box numbers. We reserve the right to not deliver to addresses different to the card holding address.
7.4 In the event of loss or damage to Goods in transit to the customer, and upon satisfactory vouching of that fact, the contract of sale shall terminate and Treasure and Relish shall refund the price paid and carriage paid by the customer forthwith.
7.5 Please allow 5-7 working days for delivery. Published delivery timescales are for guidance only. Customers may collect their purchases from our premises if they prefer, but only with prior permission. Goods will be despatched after payment in full has been received.
7.6 Our stated delivery charge includes postage and packing to mainland UK addresses and insurance in transit. All items are delivered by the Post Office, or a reputable courier company, or by our own transport.
7.7 All quoted delivery charges are for UK mainland addresses. For all non-mainland UK addresses we will quote for delivery.
Consumer Rights, Refunds & Returns
8.1 If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Goods. In this case, you will receive a full refund of the price paid for the Goods in accordance with our refunds policy.
8.2 To cancel a Contract, you must inform us in writing. You must also return the Goods to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
8.3 Goods returned to us must be un-tampered with and in their original packaging (return packing, carriage and transportation costs are the customers responsibility). All items must be returned to Treasure & Relish within 10 days of arrival with you. Note: If goods are not stored in appropriate conditions we cannot be held responsible for faults or problems that may later arise. You will not be refunded the delivery costs and you must pay for shipping the Goods back to us and insurance of the Goods during transit to us. Refund will not be made until the Goods have been returned undamaged to us.
8.4 Your statutory rights as a consumer are not affected if, for any reason, you wish to return goods bought from the Treasure and Relish website.
Copyright
9.1 Copyright in all images by living artists on the Treasure and Relish website vests in the artists and website as the case may be and in no case may any party reproduce such images without prior written permission. Copyright rights to the image remain with the artist or the estate of the artist. The purchase of an artwork does not confer the right or license to use the image for commercial or any other purpose.
Framing
10.1 Framing is only included in the prices where stated.
Descriptions
11.1 All descriptions, weights and dimensions of the goods on this website are intended only as a general guide. For the avoidance of doubt we accept no responsibility arising out of or in connection with the viewing, use or performance of our website or its content whether due to inaccuracy, error, omission or any other cause and whether on the part of Treasure & Relish, or our servants, agents or any other person or entity. Measurements of books are given in height before width and are often sized in inches (as is typical in the book trade). If in any doubt, please contact us for more information about a specific product.
11.2 The condition of pre-owned items will be described as accurately as possible with all descriptions made in good faith.
11.3 Colour - Although we make every effort to ensure the accuracy of images on our website we cannot guarantee that the colours and appearance of the Goods on the website will match the original colours.
Liability
12.1 We warrant to you that any Goods purchased from us through our site are of satisfactory quality and reasonably fit for all the purposes for which goods of the kind are commonly supplied.
12.2 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Goods you purchased. This does not include or limit in any way our liability:
i) For death or personal injury caused by our negligence;
ii) Under section 2(3) of the Consumer Protection Act 1987;
iii) For fraud or fraudulent misrepresentation; or
iv) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
Force Majeure
13.1 Treasure and Relish shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so for any damaged goods delivered that is caused by an event or circumstance that is beyond its reasonable control
Written Communications
14.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
Notices
15.1 All notices given by you to us must be given to Treasure & Relish at c/o 15 Grey Street, Harrogate, HG2 8DL. OR info@treasureandrelish.com We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 13 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

Governing Law
17.1 Our terms and conditions of sale and all other matters concerning the Treasure & Relish website shall be governed by and construed in accordance with English Law where jurisdiction shall fall.
Collection from Treasure & Relish: Please don’t hesitate to contact Treasure & Relish if you want to buy an item(s) and then make an appointment to collect it/them yourself and avoid paying carriage charges. Payments can be taken over the phone.
Buying More Than One Item: Please don’t hesitate to contact Treasure & Relish if you are buying more than 1 item and want us to quote for a single carriage charge. Payments can be taken over the phone.
